Fair Notice Violation


This letter can be used when a landlord does not provide adequate advance notice for a termination of your lease or a rent increase. If you have lived in your housing for more than six months and less than three years, a landlord must provide at least 60 days of notice before terminating your lease or increasing your rent. If you have lived in your housing for more than three years, a landlord must provide at least 120 days of notice before terminating your lease or increasing your rent. If a landlord does not give the minimum required notice, tenants have a right to stay in their housing under the prior rental agreement until the required notice period has been reached. Using this letter informs your landlord of these rights as covered under the Fair Notice Ordinance. These rules apply to all tenants with both year-long or month-to-month leases. It does not apply if there is an ongoing eviction process due to nonpayment of rent or another violation of the lease.
